    I guess I never thought of this before but...

    is it legal to name a quilt pattern that I designed the same name as someone else named their quilt if the quilt is totally different and not resemble the other persons quilt by the same name?

    It might get confusing when a person is looking for one pattern and get the other

    This is America and we have the right to quilt and design. If you made the quilt, you can call it whatever you want too!!!! (I understand why your asking but isn't it a shame we can't enjoy our hobby without the fear of stepping on someone else's toes!)

    Well you name your dog the same as other peoples dogs sometimes. ....so why not? ;-)

    Other than quilts that have the name copywrited like "Dear Jane," I don't see why not.

    I have seen quilts by the same name, but different patterns and designers.

    There are even books out their with the same titles, but different authors.

    Songs with the same name, different song writers.

    I think it would be hard to patent a name to anything LOL

    Thanks amma. I just wanted to name my quilt and raffel it off at my guild.

    Actually titles of books, titles of songs, and title of movies cannot be copyrighted. That is why you see them having the same name. Of course many people will not use the same name because if you want to have a movie that is huge on it's own merit, you don't want it to be the same name as something else. But legally it is allowed. Having said that I am not sure how that applies to patterns and quilt names because those are more like company or product names. Generally speaking two companies can have the same or similar names so long as they are not in anywhere near the same business. So I guess if you are going on that you should be fine, however, I agree with someone else that if people were to search for your pattern name in Google the other quilt may come up, which would be confusing. Perhaps you can think of a derivative of the name to use for the pattern to make it more unique?

    I did that but there were already quilts named those too. :(
